Asymmetric:With theAsymmetric service,the data speed oramount of transmitted data differs in one direction comparedwith the other direction.The system uses most of thechanneltotransmitdownstreamtotheuserandonlyasmallparttoreceive informationfrom theuser.Meaning,down link and uplinkspeeds areforinstanceon a1:2or1:3ratios(Example1024kdownlink and512kUplinkdependingonhowit istechnicallydefinedandprovisioned)

Symmetric:

With the symmetric service,the data speed or amount of transmitted data is the same inbothdirections.Thesystemuses thechannel totransmitdownstreamtotheuser atthesamerateoramountoftransmitteddataastoreceivinginformationfromthe user.Uplink and downlink speeds are on a ratioof 1:1(Example1024kdownlink and 1024k uplink).

REASONSFORTHEDECISIONAREASFOLLOWS:

KhorixasYouth and CommunityMedia Centre submittedapplicationsfora communitybroadcasting service license and spectrumuse license on12June 2013for considerationby theAuthority,in accordance with sections 85 and 101of the Communications Act,2009(Act No.8of 2009) and theRegulationsRegardingLicensingProceduresforTelecommunications andBroadcastingservice Licenses and SpectrumUse Licenses as published in Government Gazette No.4785,General Notice No.272of29August2011.

Asper the constitution submitted,KhorixasYouth and CommunityMedia Centre is a community project,founded in 2012 to provide community broadcasting services inKhorixas and surrounding areas and intends to broadcast under the K-FM brand name.An application for funding and training oflocalNamibianswassubmittedtotheUnitedNationsEducationalScientificandCultural Organisation(UNESCO)Windhoek office.

In termsof Section 101(6) of the Communications Act,2009 (Act No.8of 2009)a community broadcastingservicelicense applicationmustbe accompaniedbyspectrumuselicense application if the applicant intends to use spectrum in the provision of the intended broadcasting service. KhorixasYouth and CommunityMediaCentre submitted an applicationforspectrumuseforFM broadcasting frequency between 87 MHx and 108 MHz dated 13 June 2013 in the geographical are ofKhorixasanda transmitter outputpower of 600Watt.KhorixasYouth andCommunityMedia Centreintendstoconstruct their ownbroadcastingtransmitter tower andprovidetheir own signal distributionservice asrequired byregulation5(2) of theRegulationsRegardingLicensingProcedure for Telecommunications and Broadcasting Service Licenses and Spectrum Use Licenses.

KhorixasYouthandCommunityMediaCentresubmittedaprogramschedule,constitutionand certifiedcopiesofidentitydocuments asrequiredonthe applicationsformsforserviceandspectrum use on23August 2013.Theprogram schedule stipulates thatFMradioserviceswill bebroadcasted broadcasting transmitted tower will be located at House No. D1,Khorixas.

Anapplicantforacommunityservicelicenceisrequiredtosubmitfinancialresourcesavailable as required by Regulation 5 (2)(k) of the Regulations Regarding Licenscing Procedure for Telecommunications and Broadcasting Service Licensces and Spectrum Use Licenses -

includeastatementofaccountssettingoutthefinancialresourcesavailabletotheapplicant inrelationtothebroadcastingserviceappliedfor;"

KhorixasYouthandCommunityMediaCentresubmittedtheauthorizationlettertoconstructa broadcastingtransmittertowerbyKhorixasTownCouncilon24April2014.UNESCOconfirmed fundingoftheproject aswell asadetailedoutline ofimplementation andtrainingofstaffand volunteersfromthecommunitydirectlytotheAuthorityon19May2014.

Following due process in terms of regulation 11 of the the Regulations Regarding Licensing Proceduresfor Telecommunications and BroadcastingService Licenses and Spectrum use Licenses, theAuthoritypublishedanoticeintheGovernmentGazette5374,NoticeNo.520,dated24December 2013,allowing fourteen (14) days for public comments from the date of publication of the Notice in andsubsequentlynoreplycommentswererequestedfromKhorixasYouth andCommunityMedia Centre.Thelastdayforadecisionisthe18thofJuly2014.

TheKunene region is home to an estimated populationof 68,735 as reflected in theNamibia 2011 Population and Housing Census Main Report (Namibian Statistics Agency,2013).Khorixas is surrounded by approximately 50 villages and has limited access to information and broadcasting services.

REASONSFORAPPROVALOFTARIFFS

MWireless (Pty) Ltd t/a Africa Online (hereinafter referred to as"Africa Online"),filed for the approval of tariffs for new NAWASAT (VSAT) Products on 12 May 2014 in terms of section 53 (1) and(7) of the Communications Act,2009(Act No.8 of 2009) (hereinafter referred to as"the Act"). The submission was made to obtain approval in terms of section53(1) and (7).

Theproposed tariffs were published as General NoticeNo.128in the Government Gazette No.5479 dated10June2014forpubliccommentsintermsofsection53(10)of theActandregulation8of the"Regulations Regarding the Submission of InterconnectionAgreements andTariffs"published in GovernmentGazetteNo.4714of18May2011.

Commentswere invited from thepublic,in terms of theNoticepublished in the Gazette,within a period of fourteen(14)days from the date ofpublication,whichperiod lapsed on24thJune2014. Nopublic comments werereceived inrespect of the tariffs,and as such,noreply commentswere requiredfromAfricaOnline.

Africa Online submitted thenew tariffs in terms of section53(1)and(7) of theAct,which stipulates thatallrates andchargesreceivedinrespectofanytelecommunicationsservicesmustbeinaccordance witha tarifffiled andpermitted tocomeintooperationin accordancewiththeprovisionsofsection 53and it shouldbefiledintheprescribedmannerwith theAuthorityfor approval.

The tariff packages submitted are new packages to supplement the current NAWASAT packages approved by the Authority on 8August 2013 and published in Government GazetteNo.5460dated 8

REASONSFORAPPROVALOFTARIFFS

TelecomNamibia Limited(hereinafter referred to as"Telecom Namibia"),filedfor the approval of tariffs forMaxiPlus and MaxiPackages on 15May2014in termsof section53(1) and (7)of the Communications Act,2009(Act No.8of 2009)(hereinafter referred to as"the Act").The submission wasmade toimplement thenewpricingaspromotionalpricingintermsof section53(2)of theAct and obtain approval in terms of section 53(1) and (7).

The proposed tariffswerepublished as General Notice No.128in theGovernment Gazette No.5479 dated10June2014forpubliccomments in terms of section53(10)of theAct andregulation8of the"Regulations Regarding the Submission ofInterconnectionAgreements and Tariffs"published inGovernmentGazetteNo.4714of18May2011.The dateof therequestwas15May2014 and the promotion started on 16May2014.The promotionwill thus end on15August 2014.

Commentswereinvitedfrom thepublic,interms of theNoticepublishedinthe Government Gazette, within a period of fourteen(14) days from the date of,which period lapsed on 24 June 2014.No public comments werereceived inrespect of thetariffs,and as suchnoreply commentswererequired fromTelecomNamibia.

The following principles will apply to FixedBroadbandData only (Speedlink) Packages:

  1. Pricing are the same for home and business customers;
  2. Operators will be offered 15% discount on retail pricing;
  3. CPEisexcluded andwillbechargedforseparately(customerswill have theoptiontorent or purchase the CPE of their choice).

General

Intheeventofincorrectbilling,customersareentitledtoregisterdisputeovertheaffectedportion of theaccountbyreporting through theCustomer CareCentre'stoll freenumber1100 or thenearest Teleshop.

COMMUNICATIONSREGULATORYAUTHORITYOFNAMIBIA

  1. Allpertinentinformation asrequiredbysection53(9)was submitted totheAuthoritysuch asthetermsandconditions,whichincludesrightsandremediesavailabletocustomersinthe eventofdisputes.
  2. Thetariffscontained thecostinginformation asrequiredbysection53(18)of theAct.

The tariffsproposed aresignificant lower than thepreviously approved tariffsforSpeedlinkwith reductions between39%and 71%.This reductionwill begoodfor bothhousehold andbusiness customersalikesincedatatariffsinNamibia arestillhigh.Atthesametimethisreductionwillmake theseservicesmoreaffordableandaccessibletomorecustomers.

TheSpeedlinkProfessionalTariffsonlydifferfrom theSpeedlinkDataonly(Home andBusiness) inthesensethattoqualifyforthesetariffsyourequireastaticInternetProtocol(IP)address.This means higher speeds due to dedicated lines and will be mostly utilized by businesses.

The tariffswill benefit customers since it is a reduction from previous tariffs.The tariffs are reasonable,arenotdeemeddiscriminatoryorimpairingcompetition.

In light of the above and interms of section53of theAct,theBoard approved theSpeedlinkData onlytariffsassubmittedbyTelecomNamibia.

The public may submit inwriting to theAuthoritywrittencommentswithinfourteen(14) daysfrom thedateofpublicationofthisnoticeintheGazette.
