The licenceisissued subject to the Communications Act,2009(Act No.8of 2009)and theRegulations RegardingLicenceConditionsforSpectrumUseLicenceaspublishedin Government GazetteNo. 5354,GeneralNoticeNo.469,dated2December2013.

Reasonsforthedecision are asfollows:​

TheNamibian Broadcasting Corporation (NBC) submitted applications for four(4) spectrum use licences at RossingMountain toprovideFMbroadcastingservices toSwakopmund,WalvisBay and surroundingruralareason12September2013totheAuthorityforconsiderationintermsofsection 101of theCommunicationsActof2009(hereinafterreferred toas"theAct')andinaccordance with Regulations regarding LicensingProceduresfor Telecommunications and BroadcastingService Licences andSpectrumUseLicences aspublished inGovernment GazetteNo.4785,GeneralNotice No.272 dated 29August 2011(as amended).

The spectrum use license appliedforby theNBCrequires a service license as contained insection 101(6) of theAct.However,aspersection93 of theAct,chapterIV onBroadcastingServices is not applicable to the NBC until a date to be determined by the Minister.As such, theAuthority has not issuedabroadcastingservicelicencetotheNamibianBroadcastingCorporation.

TheNamibianBroadcastingCorporationsubmittedthespectrum useapplicationstoexpandFM broadcasting servicesinSwakopmund,WalvisBayand surrounding areasfor thefollowing languages inadditiontoradioservicesalreadyprovided-

  • i. Rukavango
  • iii. Setswana
  • ii. Silozi
  • iv. San

AlltechnicaldocumentationasrequiredbySectionGofthespectrumuselicenceapplication formwas submitted.Technical equipment specifications provided by theNBCindicated the use of Constant Impedance Broadband (CIB) combiners requiring aminimum channel spacing of O.8MHz. Itwasfurtherrequested that theAuthorityconsiders assignmentoffrequenciesbetween88MHz to108MHz.The additionalserviceswillbeimplementedontheexistingNBCtowerlocatedon RossingMountainwith apower output of5KW.

Takingintoconsideration that thisis a highmountain site,theAuthority conducted spectrum sweeps to identifyproposed frequenciesfor assignment asfollows:

i.Rukavango93.3MHz
ii.Silozi105.0MHz
iiSetswana95.5MHz

Following due process in terms of Regulations Regarding Licensing Procedures for Telecommunications andBroadcastingServiceLicences andSpectrumUseLicences,theAuthority publishedanoticeintheGovernmentGazetteNo.5460,GeneralNoticeNo103,dated8May2014 allowingfourteen (14) days for public comments.No comments were received and therefore,no replycommentswererequested from theNBC.

FM broadcasting services provided fromRossingMountain serves a population of 111,465within the geographical areas of Walvis Bay,Swakopmund and surrounding rural areas.Although the NBCalreadyoffers National Radio,NBCAfrikaans,NBCDamara/Nama,NBCGerman,NBC Oshiwambo andNBC Otjiherero within this area,broadcasting in the additional four languages namely Rukavango,San,Setswana and Silozi will extend public broadcasting service to more listeners.

TheAuthoritynoted thatno existing commercialandcommunitybroadcastingservice licensees providing services in this geographical area offers programs in the aforementionedfour languages. Theintendedservices tobeprovidedbytheNamibianBroadcastingCorporationwill address this gapinradiobroadcastingservice provision.

The application submittedcomplieswith all technicalrequirementsassetoutinSectionGof the SpectrumUse applicationformin terms of site coordinates,coverageplots,antenna heights and equipmentspecifications.

Inlightofthe above,andintermsofsection101of theAct,theAuthorityapproved the application of additional spectrum toofferFMbroadcastingservicesinRukavango,Silozi,Setswana andSan to be transmittedfromRossingMountainforthegeographical areas ofWalvisBay,Swakopmund and surroundingruralareaswith apoweroutput of5Kw.

SUBMISSIONOFDATALINKSTARIFFS:TIMEDIVISIONMULTIPLEXING(TDM) PRICINGBYTELECOMNAMIBIALIMITED COMMUNICATIONSACT,2009​

TelecomNamibia Limited(*TelecomNamibia") herebywishesto submitits newproposed permanent pricing for its Data Links ("DL") and National Express Routes ("NEX")as per Annexures A and B below to theAuthority for approval.

  • A. The proposed tariffs can be summarized as follows:
  1. TelecomNamibiaNEXgivesdirectAccesstotheTelecomNamibiaSDHBackboneand can connectfromTEXPOPtoTEXPOPwhichwereplacedatafewselected/majortowns (traffic aggregation points) in Namibia.
  2. DatalinksmakesprovisionforconnectingtwocustomerlocationswithaNetworkTermination Unit (NTU) installed at both customer end points or allows a setupwith multiple EndPoints to acentralpoint.
  3. This is provisioned through one aggregated physical hand over point at end point A.
  4. Thisproductis especiallydesignedbutnot limited toOperators,whohave to aggregate alot ofcustomerlinestotheirOperatorEquipment.
  5. A prerequisitewill be the availabilityof collocation,operator ownHub,E1/STM1Network interconnectivitywhichwillhandoverthetrafficbetween theoperatorequipment and the TelecomNamibiaNTU.
  6. The ISPPoPand TelecomNamibia's POPshould be located in the samebuilding and should alwaysbeinsideaqualifiedTelecomNamibiasite.
  7. TelecomNamibiawill charge once-off set-upfeesfor afull service(end-to-end solution fromtheA-endthroughtheinvolvednetworkelements,processes andmanagementsystems to theB-end at thesame once-offcharge.
  8. Customers arenot charged for set-upper site but for thefull link inclusive of all sites linked with a particular point-to-point connectivity.
  9. Alllocalleadsareofferedinanunbundledwayascanbediscernedfromtheattached Annexure A.
  10. Proposed products on E3 and STM1 levels will be provisioned with E3 andSTM1 interfaces.

Fortheseinterfaces,provisioningisviafibrewhichisincludedinthe priced networkelements. The prices for local leads are only applicable up to E1 level (Including multiple E1's -on a per E1 basis).The above can onlybe applied if the service is provisioned as multiple E1's.

  • B. The following guiding principles were used for the new revised pricing policy:
  1. The local kilometreband hasbeen split into twobands.
  2. National Express Routes(NEX)has been revised upwardsby 2%to account for thereduced local kilometreband.
  3. Local Leadswill be chargedseparatelybased on the approved andgazettedbusiness line rental charge.
  4. All other network elements andoperational serviceswillbe charged basedonafixed charge forbandwidthwithinakilometerband.
  5. The total tariff forafull data linkwill be made up of three components,i.e.NTU,local leads andbandwidthfixedcharges,all thatwill bechargedseparately.ThenumberofNTU's and localleadswillbedeterminedbythesolutionprovided.
  6. Aflat discount of15%hasbeen proposed on thebandwidth priceforresellers.
  7. The once-off installation or transfer chargesfor data links andNEXhave beenrevised (Refer totarifftablesbelow).
  8. The total end-to-endmanagedservicewillbeofferedtocustomersincludingall components thatwill bechargedseparately.
  9. NTU and SDH nodes will be charged separately,based on prevailing supplier costs and exchangeratefluctuationsfromtimetotime

General​

In theeventofincorrectbilling,customers are entitledtoregisterdispute over theaffectedportion of the account by reporting through the Customer Care Centre's toll free number1100 or the nearest Teleshop.
