NOTICE IN TERMS OF SECTION 53 OF THE COMMUNICATIONS ACT, 2009 (ACT NO. 8 OF 2009) READ WITH THE REGULATIONS REGARDING THE SUBMISSIONS OF INTERCONNECTION AGREEMENTS AND TARIFFS

The Communications Regulatory Authority of Namibia, in terms section 53(7) of the Communications Act read with regulation 8 of the 'Regulations Regarding the Submission of Interconnection Agreements and Tariffs', in Government Gazette No. 4714, Notice No. 126, dated 18 May 2011, herewith gives notice that it has approved the following amendment of the tariffs for Select Packages as submitted by Mobile Telecommunications Limited , which will come in force on 30 April 2015, notwithstanding date of publication of the notice in the Gazette .

REASONS FOR THE APPROVAL OF THE TARIFFS

In terms of section 53 (1) and (7) of the Communications Act, 2009 (Act No. 8 of 2009) (hereinafter referred to as 'the Act'), Mobile Telecommunications Limited (hereinafter referred to as 'MTC'), filed for the approval of amendment of tariffs for Select Packages on 29 January 2015. The submission was made to implement the amended pricing as promotional pricing in terms of section 53(2) of the Act and obtain approval in terms of section 53(1) and (7) for permanent tariffs.

The proposed tariffs were published as General Notice No. 100 in the Government Gazette No. 5683 dated 2 March 2015 in terms of Regulation 8 of the 'Regulations Regarding the Submission of Interconnection Agreements and Tariffs' published in Government Gazette No. 4714 of 18 May 2011.

Comments were invited from the public, in terms of the Notice published in the Gazette , within a period of fourteen (14) days from the date of publication of the Notice in the Gazette , which period lapsed on 16 March 2015.

No public comments were received in respect of the tariffs as published during the commenting period, and as such no reply comments were required from MTC. The date of commencement of the tariffs is 30 April 2015.

FINANCIAL AND ECONOMIC ANALYSIS OF THE MOBILE TELECOMMUNICATIONS LIMITED SELECT PACKAGES

MTC requested that the Connect Packages be discontinued and replaced by the Select Packages. The tariffs were reduced and submitted as promotional tariffs in terms of section 53(2). During the promotional period, the subscription fee was reduced by 10%.

With the demand for more data and smartphones, MTC opted to combine the Connect packages and introduce the Select packages. The package most used by MTC customers is the Connect 100 Active Package. MTC changed this package into the Select S package with a price reduction of N$ 20.00 but the added benefit of 50 SMS and 200 MB data. All out of bundle tariffs are as previously approved by the Namibia Communications Commission and subsequently by the Authority.

The lower-end packages were removed from the market, meaning that the lower-end user will no longer be served by a contract package. These customers will either have to migrate to the more expensive Select S or change to one of the prepaid packages that meet the need and demand of these customers. From the customer analysis obtained from MTC very few customers have been utilising these contracts which is one of the reasons why it has been removed. It is however not in the Authority's mandate to prescribe the packages that MTC has to offer.

The other packages that were changed into Select packages are Smartphone Lite, Smartphone and Smartphone Plus. For all these packages the subscription fees were kept the same but with added free minutes, SMS and/or data.

All requirements in terms of section 53 of the Act that deals with the approval of tariffs have been adhered to as follows:

  1. The tariffs were published as stipulated in section 53(10) of the Communications Act for comment and Mobile Telecommunications Limited stated that the tariff would come into force on 30 April 2015 as required by section 53(8) of the Communications Act that the Licensee has to indicate the date that the tariffs will come into force.
  2. All pertinent information as required by section 53(9) was submitted to the Authority such as the terms and conditions.
  3. The date of implementation in terms of section 53(8) was stipulated as 30 April 2015.
  4. The costing data as required in terms of section 53(9) was also submitted to the Authority.

The Select packages are created in view of the higher demand for data and therefore the Connect packages were transformed into Select packages to keep up with the changing needs to the consumer. The tariffs are not deemed to be impairing competition, are not below cost and are not deemed to be unreasonable in terms of section 53(19).

In light of the above, the Authority approved the amendment of tariffs for Select Packages by Mobile Telecommunications Limited.

BACKGROUND

In terms of section 53 (1) and (7) of the Communications Act, 2009 (Act No. 8 of 2009) (hereinafter referred to as 'the Act'), Telecom Namibia Limited (hereinafter referred to as 'Telecom Namibia'), filed for the approval of tariffs for Fixed Mobile Convergence on 11 February 2015.

PROCEDURAL COMPLIANCE

The proposed tariffs were published as General Notice No. 1254 in the Government Gazette No. 5692 dated 20 March 2015 in terms of Regulation 8 of the 'Regulations Regarding the Submission of Interconnection Agreements and Tariffs' published in Government Gazette No. 4714 of 18 May 2011.

The tariffs are not deemed anti-competitive and are not unreasonably discriminatory. The termination rate for voice is N$ 0.20 and for SMS N$ 0.01. Data tariffs in the region are as low as N$ 0.40. These packages will provide the customer with more choice.

All requirements in terms of section 53 of the Act that deals with the approval of tariffs have been adhered to as follows:

  1. All pertinent information as required by section 53(9) was submitted to the Authority such as the terms and conditions applicable to the provision of services by Telecom Namibia, including rights and remedies available to customers.
  2. The tariffs contained all pertinent information relating to the tariff such as costing and budget information as required by section 53(18) of the Act.
  3. The date of implementation was indicated as 12 April 2015 (which date is not less than 60 days from the date of the filling of the tariff) as required by section 53(8) of the Act.

In light of the above, the Authority approved the tariffs for the Fixed Mobile Convergence as submitted by Telecom Namibia Limited.

The Communications Regulatory Authority of Namibia, in terms of section 37 and 38 read with section 129 of the Communications Act, 2009 (Act No. 8 of 2009) and Regulation 4(3) of the Regulations regarding Rule-Making Procedures as published in Government Gazette No. 4630, General Notice No. 334 dated 17 December 2010 -

  • a) publishes the notice of intention to amend the Regulations Setting Out Broadcasting and Telecommunications Service Licence Categories as set out in Schedule 1; and
  • b) sets outs the concise statement of the reasons and purpose for the proposed amendment of the regulations in Schedule 2.

The public may make oral submissions on the proposed regulations to the Authority, at a time, date and place notified by the Authority.

Definitions

  1. In these regulations, a word or expression to which a meaning is assigned in the Act or the Regulations has the same meaning, and unless the context otherwise indicates

The Communications Regulatory Authority of Namibia, in terms of section 31 of the Communications Act, 2009 (Act No. 8 of 2009) read with regulations 11 and 20 of the 'Regulations Regarding Licensing Procedures for Telecommunications and Broadcasting Service Licences and Spectrum Use Licence, in Government Gazette No. 4785, General Notice No. 272 dated 29 August 2011 (as amended), herewith gives notice that Digital Satellite Television (Pty) Ltd has submitted an application for reconsideration, dated 24 January 2015, in respect of a decision by the Authority to decline the application for a commercial broadcasting service and spectrum use licence, which decision was

'Network Facilities' means network facilities or other facilities that facilitate the provision of telecommunications services, broadcasting services, electronic communications, communications or application services including content services.

Amendment of regulation 5 of the Regulations

  1. Regulation 5 of the Regulations is amended by the substitution of sub-regulation (1) with the following sub-regulations:
  2. '(1) The following are categories of telecommunications service licences, all of which are technology and service neutral -
  3. (a) Individual (Comprehensive telecommunications (ECNS and ECS)); and
  4. (b) Class;

The purpose of the amendment of the proposed Regulations is to align it with developments in the telecommunications industry, requirements of the Act and policies and to ensure equal treatment of community broadcasters required to register as non-profit organisations and those non-profit organisations providing telecommunications services. The amendment will also introduce a licence category that will provide network facilities or other facilities that facilitate the provision of telecommunications service, electronic communications or application services

The Communications Regulatory Authority of Namibia, in terms of section 101 of the Communications Act, 2009 (Act No. 8 of 2009) and regulations 6 and 11 of the 'Regulations Regarding Licensing Procedures for Telecommunications and Broadcasting Service Licences and Spectrum Use Licences', published in Government Gazette No. 4785, Notice No. 272, dated 29 August 2011 as amended, herewith gives notice that the person referred to in the table below, has been awarded with a spectrum use licence effective from date of publication in the Gazette :

The licence is issued subject to the Communications Act, 2009 (Act No. 8 of 2009) and the Regulations Regarding Licence Conditions for Spectrum Use Licence as published in Government Gazette No. 5354, General Notice No. 469, dated 2 December 2013.

Reasons for the decision are as follows:

The Namibian Broadcasting Corporation (NBC) submitted applications for sixty two (62) spectrum use licences to replace existing analogue television services at various intervals dating from 25 January 2012 to 17 October 2012 in accordance with Section 101 of the Communications Act, Act 8 of 2009 hereinafter referred to as 'the Act' and the Regulations regarding Licensing Procedures for Telecommunications and Broadcasting Service Licences and Spectrum Use Licences as published in Government Gazette No. 4785, General Notice. No. 272 dated 29 August 2011 (as amended) (hereinafter referred to as the 'Licensing Procedures Regulations') to the Authority for consideration.

Section 93 of the Act provides that Chapter IV of the Act is not applicable to the Namibian Broadcasting Corporation until such date as determined by the Minister of Information Communications and Technology. As such, although the spectrum applied for requires a service licence, the Authority has not issued a broadcasting service licence to the Namibian Broadcasting Corporation to date. Please note that the spectrum applied for by the Namibian Broadcasting Corporation is not deemed to be service licence exempt and therefore require spectrum use licences to be issued by the Authority after due consideration of the applications submitted.

In accordance with the Policy Guidelines for Digital Terrestrial Television published in Government Gazette No. 5346, General Notice No. 316 dated, 21 November 2013, the Namibian Broadcasting Corporation has to implement a Digital Terrestrial Television network and migrate all analogue television services to these frequencies by 17 June 2015.

All technical information related to site locations, power output and equipment to be used as required by Section G of the spectrum use licence application form have been submitted to the Authority.

The Authority awarded spectrum use licences to the Namibian Broadcasting Corporation for Phase 1 and Phase 2 of the planned implementation of digital terrestrial television services pursuant to Government Gazette No. 5231, General Notice No. 234 dated 24 June 2013 and Government Gazette No. 5863, General Notice No. 101 dated 2 March 2015.

The Namibian Broadcasting Corporation submitted a list of 16 sites for implementation of the third phase of its DTT network rollout on the 16 th of September 2014 It was further requested to assign VHF frequencies to 2 (two) sites namely: Rietfontein and Noordoewer in lieu of the UHF frequencies contained in the Regulations Setting Out the Frequency Channeling Plan for Digital Terrestrial Television as published in Government Gazette No. 5201, General Notice No. 166 dated 29 May 2013. The envisaged list of phase 3 sites to be implemented and initial frequencies applied for by the NBC is listed hereunder- Following due process in terms of Regulations Regarding Licensing Procedures for Telecommunications and Broadcasting Service Licences and Spectrum Use Licences, the Authority published a notice in the Government Gazette No . 5148, General Notice No 72, dated 13 March 2013, allowing fourteen (14) days for public comment. This notice contained all 62 applications submitted by the Namibian Broadcasting Corporation. No comments were received within the stated timeframe and subsequently no reply comments were required from the Namibian Broadcasting Corporation.

The Authority published the final notice related to the Regulations Setting out the Frequency Channeling for Digital Terrestrial Television in Government Gazette No. 5201, General Notice No. 166 dated 29 May 2013 after following a rulemaking process that commenced with the first notice published for public comment on 28 September 2012 and concluded with a public hearing on 8 April 2013. The Namibian Broadcasting Corporation also attended the public hearing.

The ITU coordinated the Frequency Channeling Plan for Namibia submitted by the Authority.

The issuance of spectrum use licences by the Authority is guided by-

  • i. Section 101 of the Communications Act, 2009;
  • ii. International Telecommunications Union Regulations and subsequent international agreements signed by Namibia as a member state of the International Telecommunications Union;
  • iii. Regulations Setting Out the Frequency Band Plan for Namibia as published in Government Gazette No. 5214, General Notice No. 191 dated 31 May 2013; and
  • iv. Regulations Setting Out the Frequency Channeling Plan for Digital Terrestrial Television as published in Government Gazette No. 5201, General Notice No. 166 dated 29 May 2013.

Furthermore, the Authority cannot consider the award of VHF frequencies (174 MHz to 230 MHz) as requested by the Namibian Broadcasting Corporation for Rietfontein and Noordoewer taking into account that no VHF frequencies were coordinated with Botswana and South Africa and that ITU iteration in accordance with the GE06 Agreement which only allowed for coordination of UHF frequencies (470 MHz to 694 MHz).

The Namibian Broadcasting Corporation should thus be awarded with spectrum use licences in accordance with the frequencies and power outputs specified in the Regulations Setting Out the Frequency Channeling Plan for Digital Terrestrial Television as published in Government Gazette No. 5201, General Notice No. 166 dated 29 May 2013.

In light of the above and in terms of section 101(1) and (2) of the Communications Act and the Licensing Procedures Regulations, the Authority awarded the Namibian Broadcasting Corporation with the frequencies as stipulated in the table above for the implementation of Digital Terrestrial Broadcasting service in the geographical areas indicated in the table.

In terms of section 53 (1) and (7) of the Communications Act, 2009 (Act No. 8 of 2009) (hereinafter referred to as 'the Act'), Mobile Telecommunications Limited (hereinafter referred to as 'MTC'), filed for the approval of amendment of tariffs for AWEH Packages on 29 January 2015.

The proposed tariffs were published as General Notice No. 100 in the Government Gazette No. 5683 dated 2 March 2015 in terms of Regulation 8 of the 'Regulations Regarding the Submission of Interconnection Agreements and Tariffs' published in Government Gazette No. 4714 of 18 May 2011.

Comments were invited from the public, in terms of the Notice published in the Gazette , within a period of fourteen (14) days from the date of publication of the Notice in the Gazette , which period lapsed on 16 April 2015.

No public comments were received in respect of the tariffs as published during the commenting period, and as such no reply comments were required from MTC. The date of commencement of the tariffs is 30 March 2015.

FINANCIAL AND ECONOMIC ANALYSIS OF THE MTC AWEH TARIFFS

The tariffs were reduced and submitted as promotional tariffs in terms of section 53(2). During the promotion period, the data offered on the Aweh GIG package was increased from 1GB to 1.1 GB. MTC submitted the amendment of tariffs under section 53(1) and (7) of the Act.

MTC requested the Authority that the Aweh Lite package be discontinued and that a package Aweh GIG be approved in terms of section 53(1) and (7) on the Act.

COMMUNICATIONS REGULATORY AUTHORITY OF NAMIBIA

With the demand for more data MTC introduced the Aweh GIG package, which has more data but less voice minutes. With the introduction of this package Namibia has made significant improvements in terms of its price rankings for data. Previously Namibia ranked the highest in terms of price for data in Africa.

With the introduction of the Aweh GIG package Namibia is now placed 8 th and competes with the middle-ranked countries. This is a significant improvement.

All requirements in terms of section 53 of the Act that deals with the approval of tariffs have been adhered to as follows:

  1. The tariffs were published as stipulated in section 53(10) for comment and the date of implementation in terms of section 53(8) was stipulated as 30 April 2015.
  2. All pertinent information as required by section 53(9) was submitted to the Authority such as the terms and conditions.
  3. The costing as required in terms of section 53(9) for this type of tariff cannot be submitted since it is a bundled package and therefore the Authority will request for the information after the promotion ceased to ensure that the tariff is not below cost. This same procedure was followed with the Super Aweh Package in 2013.

The Aweh GIG package is a package that will benefit the lower end data user such as students. The tariffs are not deemed to be impairing competition and are not deemed to be unreasonable in terms of section 53(19).

In light of the above, Authority approved the Aweh GIG packages as submitted by Mobile Telecommunications Limited and that the Aweh Lite tariff be discontinued as submitted by Mobile Telecommunications Limited.

NOTICE IN TERMS OF SECTION 53 OF THE COMMUNICATIONS ACT, 2009 (ACT NO. 8 OF 2009) READ WITH THE REGULATIONS REGARDING THE SUBMISSIONS OF INTERCONNECTION AGREEMENTS AND TARIFFS

The Communications Regulatory Authority of Namibia, in terms section 53 of the Communications Act read with regulation 8 of the 'Regulations Regarding the Submission of Interconnection Agreements and Tariffs', published in Government Gazette No. 4714, General Notice No. 126, dated 18 May 2011, herewith gives notice of the following tariffs for Data Bundles Tariffs as submitted by Mobile Telecommunications Limited , which, notwithstanding date of publication of this notice, came into force on 12 May 2015.

REASONS FOR THE APPROVAL OF THE TARIFFS:

In terms of section 53 (1) and (7) of the Communications Act, 2009 (Act No. 8 of 2009) (hereinafter referred to as 'the Act'), Mobile Telecommunications Limited (hereinafter referred to as 'MTC'), filed for the approval of amendment of tariffs for Data Bundles on 16 December 2014.

The proposed tariffs were published as General Notice No. 123 in Government Gazette No. 5692 dated 20 March 2015 in terms of Regulation 8 of the Regulations Regarding the Submission of Interconnection Agreements and Tariffs.

The public was afforded 14 (fourteen) days to comment from the date of publication of the Notice in the Gazette , which period lapsed on 7 April 2015.

No public comments were received in respect of the tariffs and as such no reply comments were required from MTC. The date of commencement of the tariffs was 12 March 2015. The MTC data bundle tariffs was originally submitted in the same letter as the N$ 2.00 for 10MB promotion on 16 December 2014.

FINANCIAL AND ECONOMIC ANALYSIS OF THE MOBILE TELECOMMUNICATIONS LIMITED TARIFFS FOR DATA BUNDLES

The tariffs were reduced and submitted as promotional tariffs in terms of section 53(2). During the promotion period the data offered was doubled on all packages. MTC submitted the amendment of tariffs under section 53(1) and (7) of the Act. These new tariffs will lead to a significant reduction in data prices.

1: Comparison of Data Tariffs in Africa

With the introduction of the lower prices on data bundles, Namibia is now placed 10 th and competes well with the middle-ranked countries. This is a significant improvement from being previously ranked the most expensive country in terms of data.

The date of implementation in terms of section 53(8) was stipulated as 12 March 2015. On 11 March 2015, the Authority addressed a letter to MTC postponing the date for a further 60 days to 12 May 2015. The letter indicated that the postponement was necessary to examine the reasonableness of the tariffs.

The tariffs are not deemed unreasonable, are not discriminatory and will not impair competition. The customers will pay the same price for double the amount of data.

All requirements in terms of section 53 of the Act that deals with the approval of tariffs have been adhered to as follows:

  1. The tariffs were published as stipulated in section 53(10) for comment and MTC stated that the tariff would come into force once the Authority approved the tariff as required by section 53(8) of the Act that the Licensee has to indicate the date that the tariffs will come into force.
  2. All pertinent information as required by section 53(9) was submitted to the Authority such as the terms and conditions, which includes rights and remedies available to customers in the event of disputes.
  3. The tariffs contained the costing information as required by section 53(18) of the Act.

The tariffs will benefit customers since they will pay the same price for double the amount of data. As such the tariffs are reasonable, are not deemed discriminatory or impairing competition.

In light of the above, Authority approved the Data Bundles packages as submitted by MTC.
