NOTICE IN TERMS OF THE REGULATIONS PRESCRIBING THE NATIONAL NUMBERING PLAN FOR USE IN THE PROVISION OF TELECOMMUNICATIONS SERVICES IN THE REPUBLIC OF NAMIBIA, NUMBERING LICENCE FEE AND PROCEDURES FOR NUMBER LICENCES: COMMUINCATIONS ACT, 2009

The Communications Regulatory Authority of Namibia, in terms of Regulation 22(1) of the Regulations regarding the National Numbering Plan for Namibia for use in the provision of Telecommunications Services in the Republic of Namibia, Numbering Licence Fees and Procedures for Number Licences as published in Government Gazette No. 5983, General Notice No. 97 dated 1 April 2016, herewith gives notice that the Applicant referred to in table below, submitted an application for a Number Licence to the Authority:

NOTICE OF APPLICATIONS FOR RECONSIDERATION IN TERMS OF SECTON 31 OF THE COMMUNICATIONS ACT, 2009 (ACT NO. 8 OF 2009) AND REGULATIONS 11 AND 20 OF THE REGULATIONS REGARDING LICENSING PROCEDURES FOR TELECOMMUNICATIONS AND BROADCASTING SERVICE LICENCES

The Communications Regulatory Authority of Namibia, in terms of section 31 of the Communications Act, 2009 (Act No. 8 of 2009) read with regulations 11 and 20 of the 'Regulations Regarding Licensing Procedures for Telecommunications and Broadcasting Service Licences and Spectrum Use Licence, in Government Gazette No. 4785, General Notice No. 272 dated 29 August 2011 (as amended), herewith gives notice that following Applicants have submitted the following applications for reconsideration:

  1. Excellent Communication (Pty) Ltd has submitted an application for reconsideration, dated 10 August 2020, in respect of a decision by the Authority which noted that the Class Comprehensive Telecommunications Service Licence (ECS and ECNS) awarded to Excellent Communication (Pty) Ltd automatically lapsed on 3 December 2019, which decision was published in Government Gazette No. 7300, General Notice No. 317 dated 7 August 2020.
  2. Loc8 Mobile CC has submitted an application for reconsideration, dated 12 August 2020, in respect of a decision by the Authority which noted that the Class Comprehensive Telecommunications Service Licence (ECS and ECNS) awarded to Loc8 Mobile CC automatically lapsed on 21 December 2019, which decision was published in Government Gazette No. 7300, General Notice No. 317 dated 7 August 2020.
  3. Demshi Investment Holdings (Pty) Ltd has submitted an application for reconsideration, dated 12 August 2020, in respect of a decision by the Authority which noted that the Class Comprehensive Telecommunications Service Licence (ECS and ECNS) and Number Licence awarded to Demshi Investment Holdings (Pty) Ltd automatically lapsed on 27 November 2018, which decision was published in Government Gazette No. 7326, General Notice No. 365, dated 2 September 2020.

The reasons and grounds for the application for reconsideration are contained in the applications that can be inspected at the offices of the Authority.

The public may submit comments in writing to the Authority within a period of fourteen (14) days from the date of publication of this notice in the Gazette .

The applicant may submit written reply comments within fourteen (14) days from the due date of the written public comments.

All written submissions must contain the name and contact details of the person making the written submissions and the name and contact details of the person for whom the written submission is made, if different and be clear and concise.

NOTICE OF RECONSIDERATION IN TERMS OF REGULATION 36(1) OF THE REGULATIONS PRESCRIBING PROCEDURES REGARDING APPLICATION FOR, AND AMENDMENT, RENEWAL, TRANSFER AND CANCELLATION OF SPECTRUM LICENSES: COMMUNICATIONS ACT, 2009

The Communications Regulatory Authority of Namibia, in terms of regulation 36(1) of the Regulations Prescribing Procedures Regarding Application for, and Amendment, Renewal, Transfer and Cancellation of Spectrum Licenses, published as General Notice No. 104, Government Gazette No. 6888, on 29 April 2019, hereby revokes the General Notice No. 285 as published in Government Gazette No. 7273, dated 15 July 2020 and herewith gives notice of the following decision:

The Authority resolved to reconsider its decision as published in Government Gazette No. 7024, General Notice No. 425 dated 17 October 2019 and approve an application for amendment of the spectrum licence of Telecom Namibia Limited, to authorize the utilization of a contiguous block of 40 MHz spectrum (2308-2348MHz) for IMT services within the entire boundaries of the Republic of Namibia subject to the spectrum license conditions.

The full reasons for the decision can be requested from the Authority. As set out in section 32(2) of the Communications Act, 2009 (Act No. 8 of 2009), any person who has a substantial interest in this decision may take this decision on review within a period of six months from the date on which that person has become aware of this decision.

NOTICE OF WITHDRAWAL OF TARIFF SUBMISSION IN TERMS OF THE REGULATIONS REGARDING THE SUBMISSIONS OF INTERCONNECTION AGREEMENTS AND TARIFFS

The Communications Regulatory Authority of Namibia, in terms of Section 53(11) of the Communications Act, 2009 (Act No. 8 of 2009) herewith gives notice that Paratus Telecommunications (Pty) Ltd has withdrawn its full tariffs submission (Sky-Fy) as published in Government Gazette No. 7312, General Notice No. 345 dated 19 August 2020.

NOTICE IN TERMS OF THE REGULATIONS REGARDING THE SUBMISSIONS OF INTERCONNECTION AGREEMENTS AND TARIFFS

The Communications Regulatory Authority of Namibia, in terms of Section 53(10) of the Communications Act, 2009 (Act No. 8 of 2009) read with regulation 8(1) of the 'Regulations Regarding the Submission of Interconnection Agreements and Tariffs', in Government Gazette No. 4714, General Notice No. 126, dated 18 May 2011, herewith gives notice that Paratus Telecommunications (Pty) Ltd has filed a tariff with the Authority as set out in Schedule 1.

Any person may examine copies of the tariffs submitted at the head offices of the Authority during normal business hours and copies may be made on payment of a fee determined by the Authority. Copies are also available at www.cran.na where copies may be downloaded free of charge.

The public may submit in writing to the Authority written comments within fourteen (14) days from the date of publication of this notice in the Gazette .

Paratus Telecommunications (Pty) Ltd may submit, in writing to the Authority, a response to any written comments within fourteen (14) days from the lapsing of the time to submit written submissions.

All written submissions must contain the name and contact details of the person making the written submissions and the name and contact details of the person for whom the written submissions is made, if different and be clear and concise.

All written submissions and reply comments must be made either physically or electronically -

NOTICE IN TERMS OF REGULATION 19(1) OF THE REGULATIONS REGARDING LICENSING PROCEDURES FOR TELECOMMUNICATIONS AND BROADCASTING SERVICE LICENCES: COMMUNICATIONS ACT, 2009

The Communications Regulatory Authority of Namibia, in terms Regulation 19(1) of the Regulations Regarding Licensing Procedures for Telecommunications and Broadcasting Service Licences, published in Government Gazette No. 4785, General Notice No. 272, dated 29 August 2011 (as amended), hereby gives notice of the following decision:

  1. The Authority noted that the Class Comprehensive Telecommunications Service Licence (ECS and ECNS) and Number Licence awarded to Demshi Investment Holdings (Pty) Ltd automatically lapsed on 27 November 2018.

The above decisions are effective from date of this Notice.

The full reasons for the decisions can be requested from the Authority. In terms of section 31 of the Communications Act, 2009 (Act No. 8 of 2009), the Authority may, on its own motion or on a petition filed by an aggrieved party to any proceedings, reconsider any order or decision that it has made, within 90 days from the date of this notice.
