NOTICE IN TERMS OF THE REGULATIONS REGARDING THE SUBMISSIONS OF INTERCONNECTION AGREEMENTS AND TARIFFS

The Communications Regulatory Authority of Namibia, in terms of Section 53(10) of the Communications Act, 2009 (Act No. 8 of 2009) read with regulation 8(1) of the 'Regulations Regarding the Submission of Interconnection Agreements and Tariffs', in Government Gazette No. 4714, General Notice No. 126, dated 18 May 2011, herewith gives notice that Paratus Telecommunications (Pty) Ltd has filed a tariff with the Authority as set out in Schedule 1.

Any person may examine copies of the tariffs submitted at the head offices of the Authority during normal business hours and copies may be made on payment of a fee determined by the Authority. Copies are also available at www.cran.na where copies may be downloaded free of charge.

The public may submit in writing to the Authority written comments within fourteen (14) days from the date of publication of this Notice in the Gazette .

Paratus Telecommunications (Pty) Ltd may submit, in writing to the Authority, a response to any written comments within fourteen (14) days from the lapsing of the time to submit written submissions.

All written submissions must contain the name and contact details of the person making the written submissions and the name and contact details of the person for whom the written submissions is made, if different and be clear and concise.

All written submissions and reply comments must be made either physically or electronically -

NOTICE OF INTENTION TO AMEND THE REGULATIONS REGARDING RULE-MAKING PROCEDURES: COMMUNICATIONS ACT, 2009

The Communications Regulatory Authority of Namibia, in terms of section 129 of the Communications Act, 2009 (Act No. 8 of 2009), and the Regulations regarding Rule-Making Procedures published in Government Gazette No. 4630, General Notice No. 334 dated 17 December 2010 -

  • a) publishes this Notice of Intention to Amend the Regulations Regarding Rule-Making Procedures as set out in Schedule 1; and
  • b) sets outs the concise statement of the reasons and purpose for the proposed regulations in Schedule 2.

The Authority invites the public to submit comments in writing to the Authority within 30 days from the date of publication of this Notice in the Gazette, and a written comment must -

  • (a) contain the name and contact details of the person making the written submissions and the name and contact details of the person or entity on whose behalf the written submissions are made, if different;
  • (b) be clear and concise; and

SCHEDULE 1

AMENDMENT OF THE REGULATIONS REGARDING RULE-MAKING PROCEDURES: COMMUNICATIONS ACT, 2009

The Communications Regulatory Authority of Namibia, in terms of sections 129 of the Communications Act, 2009 (Act No. 8 of 2009), amends the Regulations Regarding Rule-Making Procedures published under General Notice No. 334 of 2010, as set out in the Schedule.

Definition

  1. In these regulations 'the Regulations' means the Regulations Regarding RuleMaking Procedures published under General Notice No. 334 of 2010.

2. Amendment of regulation 4 of Regulations

4(2) The Authority may initiate rule-making proceedings to make regulations prescribing anything that is required to be prescribed by this Act and prescribing anything that [are] is necessary or expedient to prescribe in order to implement the provisions of the Act. [even though the Act does not explicitly require such regulations to be prescribed.]

Substitution of regulation 12 of Regulations

  1. The Regulations is amended by the substitution for regulation 12 of the following regulation.

12. Reconsideration

  • '(1) The Authority may, in terms of Section 31 of the Act reconsider any regulations made in terms of these Regulations, within 90 calendar days from the date of publication of the said regulations in the Gazette .
  • (2) Any person (hereinafter 'the requesting party') may submit a request in writing to the Authority to reconsider any regulations made in terms of the rule-making procedures, within 30 days of the publication of the final regulations.
  • (a) The requesting party must comprehensively set out its reasons for the request for reconsideration;
  • (b) The Authority must within 14 days of receipt of the request for reconsideration determine that there are grounds for reconsideration;
  • (c) Where there are no valid grounds for reconsideration, the Authority must forthwith notify the requesting party of its decision and consider the matter closed.

NOTICE IN TERMS OF REGULATION 4(7) OF THE REGULATIONS PRESCRIBING PROCEDURES REGARDING APPLICATION FOR, AND AMENDMENT, RENEWAL, TRANSFER AND CANCELLATION OF SPECTRUM LICENSES: COMMUNICATIONS ACT, 2009.

The Communications Regulatory Authority of Namibia, in terms of regulation 4(7) of the Regulations Prescribing Procedures Regarding Application for, and Amendment, Renewal, Transfer and Cancellation of Spectrum Licenses, published as General Notice No. 104, Government Gazette No. 6888, on 29 April 2019, herewith gives notice that the following applications for radio frequency spectrum were submitted:

  • (d) Where the Authority considers that the request for reconsideration should be heard, the Authority must publish the 'request for reconsideration' in the Gazette .
  • (e) The Authority should invite the public to submit written submissions to the request for reconsideration within 14 days and the requesting party may respond to the written comments within 14 days from the lapsing of the time to submit written submissions.
  • (3) The Authority must thereafter, subject to compliance with a rule-making process make a determination on the request for reconsideration within 90 days from the date of publication of the said regulations in the Gazette .
  • (4) If the Authority's decision on the request for reconsideration warrants an amendment of the regulations, the Authority must initiate a new rule-making proceeding to give effect to the outcome of the application for reconsideration.
  • (5) If the rule-making proceeding results in a different decision as contemplated in sub-section (3), the effect is that the decision shall be treated as if it was never made.

SCHEDULE 2

CONCISE STATEMENT OF PURPOSE

The purpose of the proposed amendment is to -

  • (a) Ensure that the Regulations are in line with section 129;
  • (b) Set out a process for requests for reconsideration made in terms of these Regulations.
