NOTICE IN TERMS OF SECTION 53 (7) OF THE COMMUNICATIONS ACT (ACT NO 8 OF 2009) READ WITH THE REGULATIONS REGARDING THE SUBMISSIONS OF INTERCONNECTION AGREEMENTS AND TARIFFS

The Communications Regulatory Authority of Namibia, in terms section 53(1) and (7) of the Communications Act read with regulation 8 of the 'Regulations Regarding the Submission of Interconnection Agreements and Tariffs', in Government Gazette No. 4714, General Notice No. 126, dated 18 May 2011, herewith gives notice that it has approved:

  1. Wi-Fi tariffs as submitted by Demshi Investments Holding (Pty) Ltd, which will come into force and effect on 15 February 2022 , notwithstanding the date of publication of the notice in the Gazette;
  2. Spectra Edge tariffs as submitted by Mobile Telecommunications Limited, which will come into force and effect on 30 December 2021 , notwithstanding the date of publication of the notice in the Gazette;
  3. Home and Business Fiber and Microwave tariffs as submitted by Loc8 Mobile CC, which came into force and effect on 9 December 2021 , notwithstanding the date of publication of the notice in the Gazette;
  4. LTE Infinity Lite tariffs as submitted by Paratus Telecommunications (Pty) Ltd t/a Paratus, which will come into force and effect on 31 December 2021 , notwithstanding the date of publication of the notice in the Gazette;
  5. Fiber tariffs as submitted by Paratus Telecommunications (Pty) Ltd t/a Paratus, which will come into force and effect on 31 December 2021 , notwithstanding the date of publication of the notice in the Gazette;
  6. Reconsideration of tariffs conditions as submitted by Salt Essential IT (Pty) Ltd t/a Salt Essential , which came into force and effect on 30 September 2021 , notwithstanding the date of publication of the notice in the Gazette;

NOTICE IN TERMS OF THE REGULATIONS REGARDING THE SUBMISSIONS OF INTERCONNECTION AGREEMENTS AND TARIFFS

The Communications Regulatory Authority of Namibia, in terms of Section 53(10) of the Communications Act (Act No. 8 of 2009) read with regulation 8(1) of the 'Regulations Regarding the Submission of Interconnection Agreements and Tariffs', in Government Gazette No. 4714, General Notice No. 126, dated 18 May 2011, herewith gives notice that Telecom Namibia Limited has filed a tariff with the Authority as set out in Schedule 1.

Any person may examine copies of the tariffs submitted at the head offices of the Authority during normal business hours and copies may be made on payment of a fee determined by the Authority. Copies are also available at www.cran.na where copies may be downloaded free of charge.

The public may submit in writing to the Authority written comments within fourteen (14) days from the date of publication of this notice in the Gazette.

Telecom Namibia Limited may submit, in writing to the Authority, a response to any written comments within fourteen (14) days from the lapsing of the time to submit written submissions.

All written submissions must contain the name and contact details of the person making the written submissions and the name and contact details of the person for whom the written submissions is made, if different and be clear and concise.

All written submissions and reply comments must be made either physically or electronically -

  • (1) by hand to the head offices of the Authority, namely Communication House, 56 Robert Mugabe Avenue, Windhoek;

NOTICE IN TERMS OF REGULATION 19(1) OF THE REGULATIONS REGARDING LICENSING PROCEDURES FOR TELECOMMUNICATIONS AND BROADCASTING SERVICE LICENCES: COMMUNICATIONS ACT, 2009.

The Communications Regulatory Authority of Namibia, in terms Regulation 19(1) of the Regulations Regarding Licensing Procedures for Telecommunications and Broadcasting Service Licences, published in Government Gazette No. 4785, General Notice No. 272, dated 29 August 2011 (as amended), hereby gives notice of the following decisions:

1. Lapsing and withdrawal of Service Licences

  • a) The Authority noted the lapsing of the Commercial Broadcasting License which was awarded to Usakos Community Radio .
  • b) The Authority noted the lapsing of the Commercial Broadcasting License which was awarded to Nexit Investment CC .
  • c) The Authority noted the lapsing of the Class Network Facilities Telecommunications Service License which was awarded to Lightstruck Operating Company(Pty)Ltd .
  • d) The Authority noted the lapsing of the Class Network Facilities Telecommunications Service License which was awarded to Atlas Tower (Pty)Ltd .
  • e) The Authority resolved to approve the application for the withdrawal of the Class Telecommunications Service license (ECS) awarded to Capricorn Mobile (Pty) Ltd .

2. Application for a Broadcasting Service Licence

  • a) The Authority resolved to renew the Community Broadcasting Service Licence of Trustco Mixed Marketing (Pty) Ltd .
  • b) The Authority resolved to renew the Commercial Broadcasting Service Licence of West Coast Radio CC.
  • c) The Authority resolved to decline the application for a Commercial Broadcasting Service Licence by Market Day TV Namibia CC .
  • d) The Authority resolved to award a Community Broadcasting Service Licence to Supreme Voice Radio.

The decisions above are effective from date of this Notice.

The full reasons for the decisions can be requested from the Authority. In terms of section 31 of the Communications Act, 2009 (Act No. 8 of 2009), the Authority may, on its own motion or on a petition filed by an aggrieved party to any proceedings, reconsider any order or decision that it has made, within 90 days from the date of this notice.

c) Abortive Maintenance /Call out fee's charges

Notes:

  • l The proposed rates are hourly rates and are applicable to the first hour/or part of an hour and every hour thereafter.

  • l The respective hourly rates will be applied on any abortive maintenance and or any technical support call-out.

  • l Normal TN faults within working hours will remain non-chargeable, while faults after hours will be charged, unless initiated by Telecom Namibia.

  • d) Additional charges to be considered for residential and Business Basic Line and ISDN (Outside MRA) Installation/Transfer, call out charges as well as abortive maintenance charges:

  1. l Transport cost - based on applicable AA rates (beyond MRA only)
  2. l S & T, Accommodation & Overtime - Based on TN applicable rates (only when applicable)
  3. l Material - Based on required material for given installation
  4. l CPE - Based on actual CPE used for given installation
  5. l Prior to the installation/transfer, a customer should be present with a provision quote detailing all required/possible charging component. Installation/transfer to be done only after acceptance of offer by the customer.
