NOTICEINTERMSOFTHEREGULATIONSREGARDINGLICENSINGPROCEDURES FORTELECOMMUNICATIONSANDBROADCASTINGSERVICELICENCESAND SPECTRUMUSELICENCES​

The Communications Regulatory Authority of Namibia,in terms of Regulation 11 of the"Regulations RegardingLicensingProceduresforTelecommunications andBroadcastingServiceLicencesand Spectrum Use Licences", in Government Gazette No. 4785, Notice No. 272, dated 29 August 2011 herewith gives notice of thefollowing persons who have submitted applications for transfer of control of licence:

Licensee;Type of service licence;Transferor;Transferee and percentage of stock to be held after transfer;Percentage ofStock ownedby Namibian Citizens or Namibian citizens or Namibian Compa- nies con- trolledby Namibian Citizens;Reasons for the proposed transfer;

NOTICEINTERMSOFTHEREGULATIONSREGARDINGTHESUBMISSIONSOF INTERCONNECTIONAGREEMENTSANDTARIFFS​

The Communications Regulatory Authority of Namibia, in terms of regulation 8 of the "Regulations RegardingtheSubmissionofInterconnectionAgreementsandTariffs",in GovernmentGazetteNo. 4714,NoticeNo.126,dated18May2011,herewithgivesnotice that TelecomNamibiaLimited has fileda tariffwith theAuthorityasset out inSchedule1.

Any person may examine copies of the tariffs submitted at the head offices of the Authority during normal business hours and copies may be made on payment of a fee determined by the Authority. Copies are also available at www.cran.na where copies may be downloaded free of charge.

The public may submit inwriting to theAuthoritywritten comments within fourteen(14) days from thedateofpublicationofthisnoticeintheGazette.

TelecomNamibiaLimitedmaysubmit,inwritingtotheAuthority,aresponsetoanywrittencomments withinfourteen(14) daysfrom thelapsingof the time tosubmit written submissions.

Allwrittensubmissionsmustcontainthename andcontactdetailsofthepersonmakingthewritten submissionsand thenameandcontactdetailsofthepersonforwhom thewrittensubmissionsis made,if different and be clearand concise.

1. Clarification on the PricingStructure andProductDescriptions​

1.1 Pricing Structure​

TelecomNamibiahasdefinednewTDMtransportserviceswithcleardifferentiationofhowthe different services are produced through our different network layers.

The new pricing model has also taken into account all thevarious network elements and activities

involvedinproducingthedifferentservicesin order todetermine thefinal pricepoints. WiththeoldLeasedlineservices,tariffsweredeterminedforeachelementofagivenserviceand added together toform a customer offer based on a given customer requirement or solution.Distance charges were calculated over the distance units presenting different price points for every incremental distanceunit.

Withthenewpricingstructure,asingletariffisdeterminedforatotalnetworksolutionwith all relevant elementsincluded in thepricepoint.Individualdistance chargesarenot applicablebut the pricing model defines a tariff applicable over a certain distance bracket per link speed.

The pricing model considered the network element chain involved in producing the services and products have been definedin a standard way to ensure consistency and transparency to customers and other stakeholders.

1.2 ProductDescriptions/Definitions​

Below arefull descriptions of the different services that informed the new pricing model.

Product Description

TelecomNamibiaLocalandNationalDataLinkTDMproductsaredesignedforGovernment, Corporates,Large and SME's to connect customer locations with each other.This service provides aPointtoPointconnectionbetweentwocustomerlocations.Theserviceis terminated atbothsites with a local loop and a NTU which acts as service end points.

b. NationalExpressRoutes​

ProductDescription

Telecom Namibia National Express Routes (POP -POP);is designed for carriers, operators and largeEnterprises toconnectthemajor townsinNamibiain an optimisedway.Theycanbeoffered with andwithoutprotection.The setupis optimisedregardingnumberofhops and technologies to address the demand for high capacity data transport through the country. TN POP to TN POP connectivity only.

c. OnlineServiceTDMConnect​

ProductDescription

TelecomNamibiaOnlineServiceTDMConnectproductsaredesignedforOperatorswhoconnect locations of their customers to an aggregation point.At the Aggregation Point, the Operator has to install its own Operator Hub.The traffic will be handed over with aSTM1 Interconnectbetween the Operator Equipment and the Telecom Namibia Network Node at the nearest Operator Hub.

d. TDMBackhauling​

ProductDescription

TelecomNamibia TDMBackhaulingproductsaredesignedforOperatorswhoconnectBase Stationswith TDM Services back to the next OperatorHub.At theAggregationPoint,the Operator has toinstall its own OperatorHub.The trafficwill behandedoverwitha STM1 Interconnectbetweenthe Operator Equipment and theTelecomNamibiaNetworkNode at the nearest OperatorHub.

The CommunicationsRegulatory Authority,in terms of section37,38and 84readwith section 129of the Communications Act,2009(Act No.8 of 2009),amends the Regulations Setting Out Broadcasting andTelecommunicationsServiceLicence CategoriespublishedinGeneral NoticeNo. 124 of 18 May2011.

Definitions​

  1. In these regulations, a word or expression to which a meaning is assigned in the Act or theRegulationshas thesamemeaning,and unless thecontext otherwiseindicates-

"Act" means the Communications Act, 2009 (Act No. 8 of 2009).

Amendmentof regulation1 of theRegulations​

  1. Regulation1 of theRegulations is amended by-
  2. (a) the deletion of the definition of"Broadcasting back-haul system service";
  3. (b) insertion after thedefinitionof-
  4. (i) "Amateur service"ofthefollowingdefinitions:
  5. "'Citizen Band service' means a private, two-way, shortdistance radio service usedfor thepurposeof speechcommunicationsforpersonal and business operations, which may also be used as a paging system;"; and

Class ComprehensiveMultiplex andSignalDistribution'meansproviding anelectroniccommunicationsnetworkserviceforsignaldistributionas well as operation of multiplexer equipment for the purpose of delivering broadcasting services;"and

  • (i) "Maritime service"of the following definition:

Amendment of Regulation 4 of theRegulations​

The CommunicationsRegulatoryAuthority,in termsof section37,38and84readwithsection 129of theCommunicationsAct,2009(Act No.8of 2009),amends theRegulationsSetting Out BroadcastingandTelecommunicationsServiceLicenceCategoriespublished inGeneral NoticeNo. 124of18May2011.

Definitions​

  1. In these regulations,a word or expression towhich a meaningis assigned in theAct or theRegulations has the samemeaning,andunless the context otherwiseindicates-

"Act"means the Communications Act,2009(Act No.8 of 2009).

Amendmentof regulation1 of theRegulations​

  1. Regulation 1 of the Regulations is amended by -
  2. (a) the deletion of the definition of "Broadcasting back-haul system service";
  3. (b) insertion after thedefinitionof-
  4. (i) "Amateur service"of the following definitions:
  5. "Citizen Band service'means a private, two-way, shortdistance radio serviceusedforthepurposeofspeechcommunicationsforpersonal and business operations,which may also be used as a paging system;"; and

Class ComprehensiveMultiplex andSignal Distribution'meansproviding an electroniccommunicationsnetwork servicefor signal distribution as well as operation of multiplexer equipment for the purpose of delivering broadcasting services;"and

  • (i) "Maritime service"of thefollowing definition:

"'Multiplex'means the operation of multiplexer equipment for the purpose of delivering broadcasting services;".
