AMENDMENTOFTHEREGULATIONSPRESCRIBINGPROCEDURESREGARDING APPLICATIONFOR,ANDAMENDMENT,RENEWAL,TRANSFERANDCANCELLATION OFSPECTRUMLICENCES:COMMUNICATIONSACT,2009
The CommunicationsRegulatoryAuthority of Namibia,under section129readwith section101(14) and section101(16)oftheCommunicationsAct,2009(ActNo.8of2009)-
- (a) AmendstheRegulationsPrescribingProceduresRegardingApplicationfor,andAmendment, Renewal,TransferandCancellationofSpectrumLicencespublishedintheGovernment GazetteNo.6888,GeneralNoticeNo.104dated29April2019;
- (b) Repeals the amendment to theRegulationsprescribingProceduresregardingApplication for,andAmendment,Renewal,TransferandCancellationofSpectrumLicencespublished in theGovernmentGazetteNo.7196,GeneralNoticeNo.152dated29April2020.

Substitution of regulation 12 (9) and 12(10) of Regulations
- Regulation 12(9)and 12(10) ofthe Regulations is hereby amended by the substitution ofthoseparagraphswiththefollowingparagraphs:
- "(9) The Authority must forthwith publish a notice of the aforesaid application oramendmentintermsofsub-regulation(7)intheGazetteandinvitethepublictomake writtencommentstotheAuthoritywithinthetimesetoutinthenotice,whichtimemaynot belessthan14daysfromthedateofthepublication.
- (10)TheAuthoritywill providetheopportunity to an applicant or licenseeto
Insertion of the following sub-regulations after regulation 12(10) of Regulations
- TheRegulationsis amended by the insertion of thefollowing sub-regulations after regulation12(10) of theRegulations:

- "(11)An applicant's or licensee's response to public comments must be submitted inwritingtotheAuthoritywithinthetimesetoutbytheAuthority,whichtimemaybenot lessthan14daysfromthedeadlineforthesubmissionofpubliccommentsorif thenotice forsubmissionsofresponsesispublishedinasubsequent Gazette,notlessthan14daysfrom the date of that publication.
- (12)The times for the submissions of public comments and applicant or licensee'sresponses aretobedetermined by theAuthority inlights of thenatureof the application or amendment (in terms of sub-regulation 7).
- (13)TheAuthority may considerwrittensubmissions not timeously filed if,in its opinion, it is practical to do so.
- (14)The Authority may request further written submissions, such as for further informationorclarification,whichmustbeprovidedtotheAuthorityinthetimeandthe manner set out by the Authority.
- (15)All written submissionsmust-
- (a) containthenameandcontactdetailsofthepersonmakingthewritten submissionsor thenameandcontactdetailsofthepersonforwhomthe writtensubmissionismade,if different;
- (b) be clear and concise;and
- (c) conformto anyfurtherrequirementsdetermined bytheAuthorityfromtime totime.
- (16)After considering any application made in terms of thisregulation and any writtenororalsubmissions,ifanyreferredtoherein,theAuthoritymayrefuseorgrantthe application,in whole orin part.
- (17)If the Authority grants application the Authority must amend the spectrum licensein theform determined andsubject to the conditionsimposedby theAuthority.
- (18)Afterconsidering anywritten ororal submissions inrespect ofan amendment envisaged in sub-regulation7or in case of absence of comments thereof,the Authority may amendorrefrainfromamendingthespectrumlicence.
- (19)The Authority must whether or not requested by an applicant or licensee, furnishreasonsfor its decision togrant or amend the spectrum license."
Insertion of the following sub-regulations after regulation 16(5) of Regulations

4.The Regulations is amended by the insertion of the following sub-regulations after regulation16(5) of theRegulations:

"(6)TheAuthority must forthwith publish a notice of the aforesaid application in theGazetteandinvitethepublictomakewrittencommentstotheAuthoritywithin the timesetout in thenotice,which timemaynotbelessthan14daysfrom the dateof the publication.

(7)The Authority will provide the opportunity to an applicant to respond to any written comments contemplated in sub-regulation(6).

(8) An applicant'sresponsetopubliccommentsmust be submitted inwritingto theAuthoritywithinthetimesetoutbytheAuthority,whichtimemaybenotlessthan14 daysfromthedeadlineforthesubmissionofpubliccommentsorifthenoticeforsubmissions of responsesispublished ina subsequent Gazette,notlessthan14daysfrom thedateof that publication.

ANNEXUREB
RADIOAPPARAUSEXEMPTFROMSPECTRUMLICENSE
Explanation:
- The use or possession of the radio apparatus listed in Column B below, in accordance with the specifications listed in Columns A,C, D and E of the Table below does not require a spectrumlicense.
- Use and possessionof all radio apparatus exempt intermsof the above tablemust comply with thefollowing:
- 2.1 All radio apparatusmust be type-approved by theAuthority or by theIndependent CommunicationsAuthorityofSouthAfricaor,uponrequest totheAuthority,by any otherregulatory authorityin acountry other thanNamibia orSouthAfrica.
- 2.2 Thefrequencies,transmittingpower and external high-gain antenna of theradio apparatusmust not be alteredwithout a new type-approved certificate issued by the
- 2.3 The radio apparatus must be operated within, and not exceed, the technical parameterssetoutineachof theapplicableColumns CandDof theTablewith respecttothefrequencyband,maximumradiatedpowerorfieldstrengthlimitsand channel spacing,relevant standards andduty cycles and antennas tobe used and containedinColumnE.
- 2.4 The antenna of the radio apparatusmust not be higher or above average ground level than thelowestpoint of theplacewheretheradio apparatusoperateseffectively.
- 2.5 The radio apparatusmaynot cause interferencewith any licensed radiofrequency spectrum.
- 2.6 Theuserof theradio apparatusin thelicense-exemptfrequencyspectrumoperates onanon-interferenceandzeroprotectionbasisfrominterference.

Note 1:When either duty cycle,Listen-Before-Talk(LBT) orequivalent technique applies then it shall not be user dependent/adjustable and shall beguaranteed by appropriate technicalmeans. For LBT devices without AdaptiveFrequency Agility (AFA),or equivalent techniques,the duty cycle limit applies.For any type of frequency agile device the duty cycle limit applies to the total transmissionunlessLBTorequivalenttechniqueisused.
