AMENDMENT OF REGULATIONS IN RESPECT OF TYPE APPROVAL AND TECHNICAL STANDARDS FOR TELECOMMUNICATIONS EQUIPMENT: COMMUNICATIONS ACT, 2009
The Communications Regulatory Authority of Namibia, under section 129 of the Communications Act, 2009 (Act No. 8 of 2009) and in accordance with the Regulations regarding Rule-Making Procedures published under General Notice No. 334 of 17 December 2010, has amended the regulations set out in the Schedule.

Definitions
- In these regulations the 'Regulations' means the Regulations in Respect of Type Approval and Technical Standards for Telecommunications Equipment published under General Notice No. 22 of 30 January 2015.

CONTENTS
Substitution of regulation 5 of Regulations
- The Regulations is amended by the substitution for regulation 5 of the following regulation:
'Telecommunication equipment requiring type approval
- (1) A person or entity that intends to -
- (a) connect any equipment to an electronic communication network in Namibia for purposes of electronic communications; or
- (b) use, sell or offer for sale or re-sale telecommunications equipment in Namibia,
that is not type approved or exempted from type approval in terms of these regulations, must apply on Form 1 set out in Annexure 1 and submit the telecommunications equipment to the Authority for type approval in accordance with regulation 7 prior to the use, connection, sale or re-sale.
- (2) The Authority must publish on its website -
- (a) a list of telecommunications equipment that have been type approved; and
- (b) a list of telecommunications equipment exempted from type approval .
- (3) Despite subregulation (1), but subject to subregulation (4), telecommunications equipment that -
- (a) is temporarily imported into Namibia for re-export; or
- (b) is used solely for the research and development of the equipment, demonstration of prototypes, testing or trials,
does not require type approval.
- (4) A person or entity may not import telecommunications equipment that does not require type approval without the authorisation of the Authority, and the application for the authorisation must specify -
- (a) the particulars of the equipment;
- (b) the location where the equipment is to be based;
- (c) the purpose of importing the equipment and use thereof; and
- (d) the period of stay of the equipment in Namibia.
- (5) A person or entity that intends to -
- (a) connect any equipment to an electronic communication network in Namibia for purposes of electronic communications; or
- (b) use, sell or offer for sale or re-sale telecommunications equipment in Namibia,
that has already been type approved in terms of these regulations must apply in a simplified certification process on Form 3 set out in Annexure 4 and in accordance with regulation 7 for a certificate to use, connect, sale or re-sale the already type approved telecommunications equipment.
Substitution of regulation 10 of Regulations
- The Regulations is amended by the substitution for Regulation 10 of the following Regulations:
'Effect of successful application for type approval
- (1) The holder of a type approval certificate or the owner of a telecommunications equipment that has been type approved by the Authority may only use, sell, offer for sale or connect telecommunications equipment to an electronic communications network which are identical in all material respects to the type approved telecommunications equipment in respect of which the type approval certificate has been issued.
- (2) After registration, any telecommunications equipment sample submitted at the request of the Authority may be returned to the applicant but the Authority may retain any related documents for reference purposes.
- (3) A type approval certificate is valid for a period of three (3) years, and may be renewed by the Authority on application made -
- (a) by the holder of such certificate on Form 2 set out in Annexure 3; and
- (b) within a period of not less than thirty (30) days and not more than sixty (60) days prior to the date of expiry.
- (4) An application for renewal of type approval certificate referred to in subregulation (3) is granted upon the submission of such information or documents as the Authority may require and on conditions that -
- (a) no modification in respect of the model, design, function, or other information recorded in the type approval certificate or type approval register is made to the type approved telecommunications equipment;
- (b) no significant changes are made to the technical specifications of the type approved telecommunications equipment, including but not limited to -
- (i) the operating frequency band; and
- (ii) RF power and technical standards upon which the telecommunications equipment was type approved; and
- (c) the application is accompanied by a letter from the manufacturer confirming that the telecommunications equipment is still under their support.

(5) Neither the grant of type approval, nor the acceptance of test results in terms of these regulations may be construed as a guarantee by the Authority for the proper functioning, performance or quality of the type approved telecommunications equipment.

(6) A person or entity who or which connects telecommunications equipment to an electronic communications network in Namibia must ensure that such telecommunications equipment -
-
(a) is type approved; and
-
(b) inter-connects properly with the electronic communications network.

(7) The Authority is not liable for interference caused to other equipment, injury, loss of life or damage to property arising from the direct or indirect use of the type approved telecommunications equipment.

(8) A network operator may not refuse connection of type approved telecommunications equipment unless there are reasonable grounds, as determined by the Authority, that such connection should be refused.'
Substitution of Annexure 1 of Regulations
- The Regulations is amended by the substitution for Annexure 1 of the following Annexure:

In terms of Regulation 5, 7 and 15 of the Regulations, unless exempted by the Authority, any person or entity that intends to connect telecommunications equipment to an electronic network in Namibia for purposes of electronic communications or intends to use, sell or offer for sale telecommunications equipment within the Republic of Namibia is required to complete this application for type approval.
After completing the form, sign it and submit it to the Authority as required by Regulation 7, along with the relevant application fee or proof that the application fee has been paid to the Authority.

In terms of Regulation 10(3) of the Regulations in respect of Telecommunications Equipment Requiring Type Approval any person or entity that intends to connect telecommunications equipment to an electronic network in Namibia for purposes of electronic communications or intends to use, sell or offer for sale telecommunications equipment in Namibia is required to complete this renewal for type approval prior to the expiry of a type approval certificate issued by the Authority.

SUMMARY ANd ANALYSIS OF COMMENTS RECEIVEd
1. BACKGROUNd
The Notice of Intention to amend the Regulations in respect of Type Approval and technical Standards for Telecommunications equipment was published in the Government Gazette no. 6750, General Notice 603. The Authority received written comments submission from MultiChoice Namibia. A public hearing was held on 30 January 2019 during which verbal comments and input were received. The oral and written comments received are summarized and responded to below.
2. STAKEHOLdER INPUT
2.1 Written submission
2.2.1 Multichoice
a) Regulation 10(8 )
MultiChoice Namibia submitted that regulation 10(8) be amended for the obligation, to ensure that the type approved equipment interconnects properly with electronic communications networks in Namibia, to shift from the holder of the type approval certificate to the person who connects the equipment. This is in line with the shift from person specific to equipment specific regulation.
Authority response
The Authority notes that the amendment notice did not propose to amend Regulation 10(8). The authority however accepts the proposal due to the fact that it's consequential to object of the amendment, i.e. equipment specific regulation. The Sub regulation 8 will thus be will be amended to read as follows:
'Any person who connects telecommunications equipment to an electronic communications network in Namibia must ensure that such telecommunications equipment is type approved and that it inter-connects properly with the electronic communications network.
b) Regulation 10(6)
MultiChoice submits that equipment should only be type approved once (unless there is a material change to the type approved equipment) and the renewal of the certificate after the 3 years expiry is not necessary, create red tape and unnecessarily burden on both CRAN and certificate holders.
MultiChoice is further of the view that any residual concerns are addressed by regulation 10(3) (type approved equipment sold must be identical in all material respects to the type approval certificate) and regulation 12 (revocation of type approval certificate inter alia because type approved equipment does not comply with applicable technical standards or the Regulations).
Authority response
The Authority notes that the amendment notice did not propose to amend Regulation 10(6)
Be that as it may, the Authority submits that the rationale for the expiry of the type approval certificate is to protect Namibia from being a dumping ground for old equipment. As such, the application for renewal of the certificate will need to be accompanied by a confirmation letter from the manufacture that the product is still under support.
The Authority has however, resolved to increase the period of renewal to 5 years and introduce the following requirement under 10(6)
(c) That the renewal application must be accompanied by a letter from the manufacturer confirming that the telecommunications equipment in question is still under support.
Annexure 4 form 3, should also be amended to reflect this change.
c) Regulation 5(1)
MultiChoice proposes that the use of telecommunications equipment should not require type approval if the equipment is used solely for the research and development of the equipment, demonstration of prototypes, testing or trials.
Authority response
The Authority notes the proposal and submits that such equipment will be exempted from type approval however one must get authorization from the Authority to import it into the country. Application for such authorization will require the following:
- i. Location where the equipment will be based;
- ii. Period of stay in Namibia;
- iii. Purpose of importing the equipment;
- iv. Details of the equipment
The drafter will be instructed to insert a sub regulation under regulation 5 (2) to reflect this principle.
d) Regulation 5(3)
This regulation required all equipment type approved by NCC to have been assessed by CRAN within six months of the Regulations having come into effect. MultiChoice proposes the deletion of this regulation as the Regulations have been in effect for nearly four years.
Authority response
The proposal is accepted and sub regulation 5(3) is deleted.
2.2.2 Bits and Bytes Technologies CC
Bits and Bytes Technologies submitted that the Authority should exempt motherboards (LAN and Wi-Fi), laptops (LAN and Wi-Fi), wireless mice, wireless keyboards, wireless headsets and wired and wireless add-ons (NIC) to computers.
The reason for the request is that there is no connection that can be made from any of the mentioned devices to the internet as one will only access the gateway IP which is needed to connect to the internet.
The further submitted that such exemption will allow for the market to adjust faster to the new technological trends and allow more competition between IT companies in Namibia since there is currently no one willing to go through the hassle of type approval on such products due to the time frame involve to get suppliers to apply and for the suppliers to request letters of type approval from the manufacturers.
Authority response
The proposal is accepted, and the type approval exemption list will be updated.
2.2 Oral submissions
At the public hearing that took place on 30 January 2019, the Authority received the following comments:
2.2.1 Radio Electronics
- a) Radio electronics objects to type approval per equipment on grounds that a lot of time and resources is spent in the application for type approval and they opine that other people requiring a type approval certificate cannot just get a certificate without putting in the same effort.
Authority response
The introduction of equipment specific regulation, which resulted in exemptions of type approval, was considered after consultations with several stakeholders who raised challenges with obtaining the required documentation from manufacturers, benchmarking with other regulators and special regard to introducing a framework which supports international treaties on the free flow of goods and services into the country.
Further, the Authority is of the view that equipment specific regulation is reflective of the intention of the legislature as captured in Section 80 of the Communications Act. This intention includes inter alia that equipment are type approved and that the Authority has satisfied itself that equipment entering the Namibian boarders will not pose a hazard to public safety. The Authority views the comments of radio electronic as aimed at using the regulatory process to maintain a monopoly in the supply of telecommunications equipment. The proposal will thus not be considered.
- b) Radio electronics further requested the Authority to clarify whether, there is a difference between low high powered devices and how the Authority intends to monitor the difference.
Authority response
The Authority considers low powered devices as those transmitting at less than 10 Mw and anything above this is classified as high powered devices. A number of low powered devices will be exempted from type approval and the Authority will ensure compliance via its monitoring and enforcement provisions.
1.1.2 ICT Trading Enterprise
- a) ICT Trading enterprise also objects to the proposed type approval per equipment and not per person.

See response as provided to Radio Electronic above.
- b) ICT Trading Enterprise also queried on the procedure for the application of type approval when there is already a type approval certificate.
Authority response
The Authority has introduced a simplified type approval process for equipment already type approved.
- c) Raised a concern that the exemption of products with 10MW output or less will lead to equipment owners lying about the specifications in order to avoid applying for type approval certificates. Propose that the Authority need to put in stringent measures to ensure that right equipment enters the boarder without certification.
Authority response
The Authority will ensure compliance via its monitoring and enforcement provisions.
- d) ICT Trading enterprises further enquired whether the Authority will be type approving the module or the end product.
Authority response
The Authority will type approval any devices that fall under the definition of telecommunications device as defined in the Regulations.
- e) ICT Trading Enterprises further submitted that there are some equipment that are regarded as short range that do not operate in the 2.4 - 2.8 MHz and requested that the Authority needs to clarify whether such equipment are also exempted from type approval.
3. WAY FORWARd
The Authority noted the stakeholders' comments, which are cumulatively considered as follows:
- a) Type approval of equipment will be equipment specific and not per person;
- b) Application for a type approval certificate will still require for equipment already type approved, but this will be done via a simplified type approval process;
- c) Regulation 10(8) will be amended as consequential to the object of equipment specific regulation, although it was not proposed in the Amendment notice;
- d) The expiry of the certificate will remain 3 years and application for renewal of a type approval certificate will require a letter confirmation letter from the manufacture that the product is still under support;
- e) Equipment imported for research and development purposes will not require a type approval certificate, however authorization to import such equipment should be granted by the Authority;
- f) Regulation 5(3) will be deleted;
- g) The list of exempted equipment will be updated to include exemptions for equipment proposed by Bits and Bytes Technologies and others identified by the Authority (The updated list is attached hereto as Annexure 'A';
- h) Type approval fees will be adjusted in line with inflation and all equipment appearing on the exemption list will be removed.

- f) Further proposed that the expiry date should be indicated on the type approval certificate for certificate holders' control purpose.
Authority response
The proposal is noted and the expiry date will be reflected on the certificates going forward.
